GENERAL TERMS AND CONDITIONS

All mountain guides of the mountain guide agency Engelberg work in principle under the general booking regulations of the Swiss Mountain Guide Association.

Here are the most important excerpts & adjustments:

General
A booking with the mountain guide agency Engelberg will be forwarded to a qualified mountain guide by the carefully selected team. The general terms and conditions of the individual guides may vary slightly.

“Covid Special” Winter 2022

Engelberg guarantees a free cancellation of your booking (hotels, train tickets, restaurants, activities) until 48h before arrival:

  • official restrictions on travel to Engelberg or back to your place of residence
  • official restrictions of the booked tourist businesses or activities in Engelberg
  • in case of a Covid19 suspected case in the travel group with medical certificate

Registration
Registration is via the booking form on the EngelbergMountainGuide.ch website.
Upon receipt of your registration, we will confirm it immediately by e-mail and shall be deemed to be binding. Since offers and courses can be fully booked, we recommend early registration. Your personal data will not be stored in our customer database for third parties to see. Their use is limited exclusively to business activities (information for tours, consultations, newsletter dispatch).

Payment
Upon receipt of the booking confirmation we will send you an invoice in PDF format. This must be paid at least 30 days before the start of the tour or course. Short-term bookings must be paid immediately by credit card or cash.
If you pay in advance for 2 months or more, we grant you a discount of 3%.

Withdrawal
The following costs will be charged in the event of withdrawal from the contract:

Cancellation 60 to 31 days before the tour or course starts:
25 % of the fees

Cancellation 30 to 11 days before the tour or course starts:
50 % of the fees

Cancellation 10 days or later before the tour or course starts:
100% of the fees

In the event of premature termination of a course by a participant, nothing will be refunded. Furthermore, we reserve the right to cancel a course at short notice if the number of participants is insufficient, whereby all amounts paid by registered persons will be refunded in full. We recommend that you take out travel cancellation insurance.

In case of extreme external conditions (e.g. closed ski area, very high avalanche danger) we offer a comparable tour in another area. If it is not possible to offer such a program, we will refund the full amount.

Further claims of the customer are excluded.

Insurance
Personal insurance cover is the responsibility of the participants. The participant is obliged and responsible to provide sufficient insurance cover, whereby in addition to an obligatory accident and health insurance valid for the respective tour, a travel cancellation insurance is expressly recommended. We also recommend membership of the Swiss Rescue Airline REGA as a patron, as this membership includes insurance cover for rescue and recovery costs.

Legal questions / liability / damages
As qualified mountain guides with a Swiss federal certificate, we professionally manage the risk in the mountains. As an activity taking place outside in nature, all risks can never be excluded, despite appropriate professionalism and care. By booking, you acknowledge any remaining risks and dangers and waive any claims for damages and other claims against the organiser.

Program changes
Skiing and mountaineering are activities that take place in nature and are exposed to meteorological influences, which on the one hand is part of the fascination and on the other hand entails short-term programme changes. Therefore, the mountain guides take the right to make such program changes under appropriate conditions, always trying to put together an adequate program. Any additional costs shall be borne in full by the participants.

Place of jurisdiction
Swiss courts have exclusive jurisdiction for all disputes, regardless of the nationality of the participants or the place of damage. The place of jurisdiction is defined by the location of the mediated organiser.
