Terms and Conditions

All mountain guides of the Engelberg Mountain Guide Agency operate under the general booking conditions of the Swiss Mountain Guide Association.

Here are the most important excerpts & adaptations:

General
A booking with the Engelberg Mountain Guide Agency is forwarded to a certified mountain guide from the carefully selected team. The terms and conditions of individual guides may vary slightly.

Registration
Registration is done via the booking form on the EngelbergMountainGuide.ch website.
Upon receipt of your registration, we will confirm it immediately by email, and it is considered binding. As offers and courses may be fully booked, we recommend early registration. Your personal data will be stored in our customer database and will not be visible to third parties. Its use is limited exclusively to business activities (information for tours, feedback, newsletter distribution).

Payment
Upon receipt of the booking confirmation, we will send you an invoice in PDF format. This must be paid no later than 30 days before the start of the tour or course. Last-minute bookings must be paid immediately by credit card or cash.

Cancellation
In the event of a contract cancellation, the following costs will be charged:

Cancellation 60 to 31 days before the start of the tour or course:
25% of the fees

Cancellation 30 to 11 days before the start of the tour or course:
50% of the fees

Cancellation 10 days or later before the start of the tour or course:
100% of the fees

In the event of an early termination of a course by a participant, no refund will be given. Furthermore, we reserve the right to cancel a course at short notice due to an insufficient number of participants, in which case all amounts paid by registered persons will be fully refunded. We recommend that you take out travel cancellation insurance.

In extreme external conditions (e.g., ski area closed, very high avalanche risk), we offer a comparable tour in another area (see Program Changes). If it is not possible to offer such a program, we will refund the full amount.

Further claims by the customer are excluded.

Insurance
Personal insurance coverage is the responsibility of the participants. The participant is required and responsible for ensuring adequate insurance coverage, which, in addition to compulsory accident and health insurance valid for the respective tour, explicitly includes travel cancellation insurance. Furthermore, we recommend membership with the Swiss Air-Rescue REGA as a patron, as this membership includes insurance coverage for rescue and recovery costs.

Legal Questions/Liability/Damages
As qualified mountain guides with a federal certificate, we manage risk in the mountains professionally. However, as an outdoor activity in nature, all risks can never be completely excluded despite corresponding professionalism and care. By booking, you acknowledge the remaining residual risks and hazards and waive any claims for damages and other claims against the organizer.

Program Changes
As outdoor activities, skiing and mountaineering are subject to meteorological influences, which is part of the fascination but also brings about short-term program changes. Therefore, the referred mountain guides reserve the right to make such program changes under corresponding conditions, always striving to put together an adequate program. Any additional costs are fully borne by the participants.

Jurisdiction
For all disputes, Swiss courts have exclusive jurisdiction, regardless of the nationality of the participants or the location of the damage. The place of jurisdiction is defined based on the location of the referred organizer.
